1. Agreement to terms

By accessing or using laviondigital.com (the “Site”) or engaging our services, you agree to these Terms & Conditions. If you don’t agree, please don’t use the Site. These terms apply to all visitors and clients.

2. About these terms

These terms govern your use of the Site and the general relationship between us. Specific projects are governed by a separate written project agreement or proposal, which takes precedence over these terms where they conflict.

3. Services

We provide web development and related services, including custom websites, WordPress and Shopify development, e-commerce, web applications, performance optimization, SEO, maintenance, and consulting. The exact scope, deliverables, timeline, and price of any engagement are defined in a written proposal or agreement for that project.

4. Quotes, proposals & payment

  • Quotes are based on the scope discussed and are valid for 30 days.
  • Work typically begins after acceptance of the proposal and payment of the agreed deposit.
  • Payment terms (deposit, milestones, final balance) are set out in the project agreement.
  • Late payments may pause work and are subject to the terms in the project agreement.
  • Prices are exclusive of any applicable taxes unless stated otherwise.

5. Client responsibilities

To deliver on time, we rely on you to:
– Provide required content, assets, and access promptly.
– Give timely feedback and approvals at each stage.
– Ensure you have the rights to any materials you provide.
– Designate a decision-maker for approvals.

Delays in providing these may affect the timeline and cost.

6. Revisions & scope

The number of revisions and the agreed scope are defined in each project proposal. Requests beyond the agreed scope (“scope changes”) may be quoted and billed separately, by prior agreement.

7. Intellectual property & ownership

  • Upon full payment, you own the final deliverables and custom code produced for your project.
  • we retain ownership of any pre-existing tools, frameworks, libraries, or reusable components, and grant you a license to use them as part of your project.
  • Third-party components (themes, plugins, fonts, stock assets) remain subject to their own licenses.
  • Unless you request otherwise in writing, we may display the completed work in our portfolio and marketing.

8. Third-party services

Projects may rely on third-party services (hosting, plugins, payment gateways, APIs). We’re not responsible for the availability, performance, changes, or policies of these third parties, though we’ll help select reliable ones and integrate them properly.

9. Warranties & support

  • we take reasonable care to deliver work that is functional and matches the agreed specification.
  • A post-launch support window (as defined in the project agreement) covers fixes to defects in the original work.
  • Beyond that window, ongoing support and maintenance are available under a separate maintenance plan.
  • Except as expressly stated, services are provided “as is” without further warranties to the fullest extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from a project is limited to the amount you paid for that project. We’re not liable for indirect, incidental, or consequential losses (such as lost profits, revenue, or data), or for issues caused by third-party services, your own changes, or misuse of the deliverables.

11. Confidentiality

We treat non-public information you share in the course of a project as confidential and won’t disclose it to third parties except as needed to deliver the work or as required by law. We expect the same regarding any confidential methods or materials we share with you.

12. Cancellation & refunds

  • Either party may end an engagement in writing as set out in the project agreement.
  • On cancellation, you’re responsible for payment for work completed up to that point.
  • Deposits are generally non-refundable once work has started, unless the project agreement says otherwise, as they reserve time and cover initial work.

13. Use of the site

You agree not to misuse the Site. Including attempting to gain unauthorized access, disrupting its operation, or using it for unlawful purposes. Site content is provided for general information and may change without notice.

14. Governing law

These terms are governed by the laws of Pakistan. Any disputes will be subject to courts of Pakistan, unless otherwise agreed in writing.
